What are Florida's security-deposit notice deadlines?

Florida uses different dates depending on whether the landlord intends to claim part of the deposit. The packet needs the tenancy end date, last known mailing address, deposit amount, claimed deductions, and envelope or mailing proof before the timeline can be read.

What happens when there is no claim?

Florida Statutes section 83.49(3)(a) says that when the landlord does not intend to impose a claim, the landlord has 15 days after the tenant vacates at lease termination to return the deposit, together with interest when otherwise required.

What happens when the landlord claims a deduction?

The same section gives the landlord 30 days to send written notice by certified mail to the tenant's last known mailing address, stating the intent and reason for the claim in substantially the statutory form. The form tells the tenant that a written objection must be made within 15 days after receiving the notice if the tenant disputes the deduction.

What does a missed notice mean?

The statute says a landlord who fails to send the claim notice on time must return the deposit, while preserving a later lawsuit for damages. That sentence illustrates why a deadline check cannot decide the whole dispute.
